What is Criminal law?

Criminal law is the body of law that relates to crime. It prescribes conduct perceived as threatening, harmful, or otherwise endangering to the property, health, safety, and morl welfare of people inclusive of one’s self. Most criminal law is established by statute, which is to say that the laws are enacted by a legislature. Criminal law includes the punishment and rehabilitation of people who violate such laws.

Criminal law varies according to jurisdiction, and differs from civil law, where emphasis is more on dispute resolution and victim compensation, rather than on punishment or rehabilitation.

Criminal procedure is a formalized official activity that authenticates the fact of commission of a crime and authorizes punitive or rehabilitative treatment of the offender.

When to hire a Criminal Defense attorney

A criminal defendant generally has two options: a public defender or a private lawyer. It is important to weight the pros and cons of either option. Your choice will depend on your personal circumstances.

Pros - Public Defense

Public defenders are attorneys appointed to people who cannot cover the cost of hiring a private attorney. These defendants must request a public defender to avoid the often steep prices of private attorneys.

Another valuable attribute that public defenders bring to the table is their wide range of criminal experience. Given the sheer volume of cases some of these attorneys take on, their overall experience with criminal law is often broader than private criminal attorneys.

Cons - Public Defense

The Public Defense System in our Country is overloaded and underfunded. Many public defenders spend mere minutes consulting with their clients before going to trial. Leading to un-favorable outcomes for their clients, like taking a plea deal for a crime they never committed.

It is also worth mentioning that when requesting a public defender, the defendant has no choice of lawyer. The process of getting a new public defender after already being appointed one can be difficult.
